This policy applies to all purchases made through D.Dawson & Co, Tall Emu, www.ddawson.com.au, direct invoice, quotation, or special order.
1. No Change of Mind Returns
We do not offer refunds, returns, or exchanges for change of mind.
All purchases are considered final once payment has been made.
Customers are responsible for ensuring products are suitable for their intended use prior to purchase.
2. Commercial & Trade Orders
All commercial, trade, wholesale, bulk, made-to-order, imported, or custom-configured products are strictly non-refundable and non-cancellable once production or dispatch has commenced.
Deposits are non-refundable.
3. Custom & Branded Products
No returns, cancellations, or refunds are accepted for:
- Custom-printed umbrellas
- Branded café barriers
- Custom canopy colours
- Special imports
- Modified frame configurations
Design proofs are provided for customer approval. Once approved, the customer accepts full responsibility for spelling, layout, colours, artwork positioning and specifications.
4. Inspection on Delivery
Customers must inspect goods immediately upon delivery.
Any claim for:
- Freight damage
- Missing items
- Incorrect product
Must be reported in writing within 48 hours of delivery with photographic evidence.
Failure to notify within this timeframe constitutes acceptance of the goods as delivered in satisfactory condition.
5. Returns Eligibility (Non-Faulty Goods)
Returns are accepted only where required under Australian Consumer Law.
If a return is approved at our discretion:
- Item must be unused
- In original packaging
- Undamaged
- In resaleable condition
- Return requested within 7 days
A 15%–25% restocking fee may apply.
Return freight, insurance, and handling costs are the responsibility of the customer.
Original shipping charges are non-refundable.
6. Warranty Coverage
- Fabric Canopies: 5-year warranty
- Frames: 3-year warranty
- Accessories, fittings, pulleys, bases and hardware: 12-month warranty
Warranty covers manufacturing defects only.
7. Warranty Exclusions
Warranty does not cover:
- Wind damage (including moderate or unexpected wind gusts)
- Failure to close umbrella during adverse weather
- Storm, cyclone, or extreme weather events
- Improper installation or anchoring
- Insufficient base weight
- Use without recommended ballast
- Corrosion (including coastal or high-salt environments)
- Misuse, neglect, impact damage
- Commercial overuse beyond design intent
- Normal wear and tear
- Fading from UV exposure
- Acts of nature
Umbrellas must be closed and secured when not in use. Wind damage is not considered a manufacturing fault.
8. Limitation of Liability
To the maximum extent permitted by law:
- D.Dawson & Co are not liable for indirect, incidental, consequential or special damages.
- Liability is limited to the repair or replacement of the product or refund of the purchase price at our discretion.
- We are not responsible for property damage, injury, loss of business, or loss of income arising from product use.
Products are used at the customer’s own risk.
9. Repairs & After-Sales Service
Repairs are available through The Broken Umbrella division.
Customers must remove umbrellas from bases and secure for collection.
Freight charges apply.
10. Australian Consumer Law
Nothing in this policy excludes, restricts, or modifies rights under the Australian Consumer Law.
